List of Judges of the Luxembourg Family Courts (Luxembourg Tribunal & Diekirch Tribunal)

Bâtonnier Mr. François KREMER, the President of the Luxembourg Bar Association continuously refuses to make the List of Judges of the Luxembourg Family Courts publicly accessible.

Although FAD – Fathers Against Discrimination a.s.b.l. has had the THE LIST in its possession for quite sometime our understanding is that in accordance with the EU judicial system’s transparency regulation it has to be a common practice that the lists of judges residing in a specific court are publicly accessible allowing those interested to have free access to the information. We understand that both lists (Luxembourg Tribunal & Diekirch Tribunal) can also change every year as it happened in 2019 so it is clear that the lists not only should be publicly accessible but updated when necessary and appropriate.

FAD – Fathers Against Discrimination a.s.b.l. promotes gender equality of chance in all aspects of the Luxembourg society. We support the rights of fathers and mothers to equal parenthood and successful professional career. We address the importance of family values promoting the positive impact a full and healthy family has on the upbringing of children.

For a parent and child, being together is an essential part of family life. Their separation has irremediable negative effect on their relationship and the up-bringing of the children. Equality between parents must be guaranteed and promoted from the moment the child arrives. A child should never be deprived of his natural human right to family life and equal access to both parents. Nor does anyone has the right to decide which of his parents’ love has more value.

Luxembourg Family Judges, members of an elite group, deciding every day about children’s future and their well-being have a legal instrument in their hands to do the right thing. Article 378-1 of the recently changed Luxembourg Civil Code allows introduction of Equal Shared Parenting – Alternating Residence (Equal Résidence Alternée) regardless if a custodian parent agrees or not. Unfortunately, Equal Résidence Alternée is rarely introduced in Luxembourg.

The legislators and judges in most cases remain immune to the evidence provided by over 40 years of empirical studies, scientific conclusions and consensus among internationally recognized psychologists confirming that Equal Shared Parenting – Alternating Residence (Equal Résidence Alternée) is the most effective model bringing emotional stability to children during separation and after divorce of the parents.

 Most importantly Equal Résidence Alternée protects the children by removing the possibility for either parent to use them as an instrument of blackmail.

Please use below information to contact the judges on an individual or collective basis and sign FAD Petition to help Equal Résidence Alternée become default law and a starting point for all custody proceedings in Luxembourg.
