Parental Authority vs Equal Shared Parenting.
FAD.lu – Fathers Against Discrimination received questions from fathers and mothers who were under impression that the changes in the Luxembourg Divorce Law from Nov. 1st, 2018 include Shared Parenting. This is not the case.
Parental Authority for all parents married or not does not mean introducing 50/50 Shared Parenting as a rule for custody proceedings. A parent following separation / divorce can have full parental authority, keeping all the parental rights and still see the children only every 2nd weekend.
Unfortunately, the confusion partially comes from the way how the change of the law was presented to the public. Gender and parental inequality in Luxembourg courts continue.
SHARED PARENTING DOES NOT RESOLVE EVERY ISSUE PARENTS DEAL WITH DURING AND AFTER DIVORCE BUT IT PROTECTS THE CHILDREN BY REMOVING POSSIBILITY FOR EITHER PARENT TO USE CHILDREN AS AN INSTRUMENT OF BLACKMAIL.
