Equal Shared Parenting – Alternating Residence is women’s rights issue. Luxembourg government and the Ministry of Justice seem not to understand it.

The new Luxembourg “Family Law” from Nov. 1st, 2018 although publicized as revolutionary allows Equal Shared Parenting – Alternating Residence only as an option and a subject to custodian parent approval. Not like in Belgium where Equal Shared Parenting – Alternating Residence is a rule for children custody proceedings since 2006 regardless if both parents agree or not.

The new Luxembourg “Family Law” not only demoralises women by incentivising them not to work it also introduces an option of boycotting Equal Shared Parenting – Alternating Residence, proven to be the best model for children during separation and after divorce, by allowing mothers not to agree to the model and then awarding them with custody of the children. Downgrading women’s role to caretakers ignoring their rights, freedom and interest to professional career.

The result of this is separation between children and fathers, a form of child abuse reducing father’s role to a visitor violating the European Convention of Human Rights and the UN Convention on the Rights of the Child.
